Terms and Conditions
Please read these terms carefully before using our services.

We grow fresh, nutrient-dense microgreens sustainably in Phoenix and Mesa, AZ, and deliver them straight to your door. These Terms and Conditions ("Terms") apply to your use ofwww.mighty-micro.com (the "Site") and all purchases, including subscriptions and one-time orders. By using the Site or placing an order, you accept these Terms. MightyMicro LLC is an Arizona limited liability company. These Terms are governed by Arizona law, without regard to conflict of laws principles. We aim for transparency because trust is key to our sustainable mission.
1. Introduction
These Terms cover your interactions with us, from browsing to buying. They incorporate our Subscription Agreement for subscribers. Acceptance occurs by using the Site, creating an account, or ordering. This ensures everyone understands expectations, protecting both you and our small business.
2. Eligibility
You must be at least 18 years old to use the Site or order. We comply with COPPA by not directing our Site to children under 13. If we collect data from children, we follow COPPA requirements—see our Privacy Policy. This rule exists to protect young users and align with federal law.
3. Products & Services
We offer fresh microgreens in 2oz, 4oz, 8oz packages, with varieties planted 10 days before harvest for peak freshness. If a requested variety is temporarily unavailable, we'll contact you within 48 hours to offer: (a) a comparable substitution, (b) a credit toward your next order, or (c) if you decline both, the option to skip that delivery at no charge. This 10-day grow cycle ensures custom, sustainable production, minimizing waste.
4. Ordering & Subscriptions
We offer subscriptions at weekly (every 7 days), bi-weekly (every 14 days), and monthly (every 28 days) frequencies. This subscription will automatically renew on a weekly/bi-weekly/monthly basis. Your selection of variety, size, and quantity will be the same unless you request a change through the order form that will be emailed and/or texted to you before each grow cycle for your subscription frequency. You will receive an email/SMS reminder 10 days before your next scheduled delivery, allowing you adequate time to modify, skip, or cancel. Customers may change their microgreen variety, package size (2oz, 4oz, 8oz), and quantity for each delivery cycle by providing at least 10 days' notice before their scheduled delivery day. This advance notice is required because microgreens are planted specifically for your order based on the 10-day grow cycle from seed to harvest. If the request for an order change is received later than 10 days before delivery day, the change will be applied to the subsequent delivery. You may skip any scheduled delivery or temporarily pause your subscription at any time by contacting us, provided you give the required advance notice for your subscription frequency (7 days for weekly, 10 days for bi-weekly/monthly). You may also change your delivery frequency (weekly, bi-weekly, or monthly) at any time by contacting us directly. One-time orders follow similar processes without auto-renewal. Auto-renewal keeps your fresh greens coming conveniently, but we make changes easy to fit your life.
4A. ONE-TIME PURCHASES For customers who prefer to purchase without a subscription:

ADVANCE NOTICE REQUIREMENT: Due to our 10-day grow cycle (seed to harvest), one-time orders must be placed at least 10 days before your desired delivery date. We will confirm availability and delivery date within 24 hours of receiving your order. 
PAYMENT: One-time orders are charged at the time of order placement (or upon order confirmation if placed by phone/email). Payment must be received before we plant your microgreens. 
PRICING: One-time orders are charged at regular retail pricing. Subscribers receive 10% off all orders. 
CHANGES & CANCELLATIONS: - Changes to variety, quantity, or delivery date must be requested at least 7 days before scheduled delivery - Cancellations must be made at least 7 days before scheduled delivery for a full refund - Cancellations made less than 7 days before delivery but before harvest (3 days before delivery) will receive a 50% refund or credit toward future purchase - No refunds after harvest is confirmed (3 days before delivery), but we will offer credit toward future purchase 
ORDER CONFIRMATION: You will receive email confirmation of your one-time order including: - Varieties, quantities, and pricing - Scheduled delivery/pickup date and time - Delivery address and any special instructions 
TERMS ACCEPTANCE: By placing a one-time order, you acknowledge that you have read and agree to these Terms and Conditions and our Privacy Policy.
5. Pricing & Billing
Customers are charged 3 days before delivery once harvest is confirmed. Pricing varies based on the microgreen varieties, package sizes, and quantities selected for each order. Active subscribers receive 10% off regular retail pricing on all orders (except the 8-Week Discovery program, which is pre-discounted). Other promotions may apply and can be stacked with the subscriber discount. We reserve the right to adjust pricing with 30 days' notice to active subscribers. If you do not accept the new pricing, you may cancel without penalty. Accepted payment methods include credit/debit cards, ACH, Zelle, Google Pay, Apple Pay, Venmo, and PayPal. If payment fails, we will attempt to contact you and retry payment once. If payment cannot be processed by the scheduled harvest date, your delivery will be canceled and you'll need to reactivate your subscription. After two consecutive payment failures, your subscription may be terminated. You may reactivate at any time by updating your payment method. We charge post-harvest confirmation to avoid billing for unavailable crops, promoting fairness.
6. Delivery & Pickup
MightyMicro delivers throughout the Phoenix Valley. Delivery is FREE for subscription orders over $20 (or $25 for non-subscribers) within 30 miles. Orders over these amounts beyond 30 miles incur $0.20/mile. Orders under $20/$25 have a $5 delivery fee up to 20 miles, then $0.25/mile thereafter. Maximum delivery fee is $15. Miles are calculated by actual driving distance.

Orders over $20 beyond 30 miles: $0.20/mile additional
Orders under $20: $5 delivery fee (up to 20 miles), then $0.25/mile beyond 20 miles
For Non-Subscribers:
Orders over $25 within 30 miles: FREE
Orders over $25 beyond 30 miles: $0.20/mile additional
Orders under $25: $5 delivery fee (up to 20 miles), then $0.25/mile beyond 20 miles
Typical delivery days are Saturdays, with routes beginning in the late afternoon. You'll receive notification in advance of your scheduled delivery window. Weather delays or unforeseen circumstances will be communicated promptly via email or phone. Pickup is available anytime on Saturday between 7am - 7pm. We will deliver to your door or specified location. If you require special delivery instructions (gate codes, side door, etc.), please provide these when subscribing. We will knock/ring but do not require signature. Products left unrefrigerated are the customer's responsibility after delivery attempt. These fees and methods ensure local, sustainable delivery while covering costs fairly.
7. Cancellations & Refunds
Weekly subscriptions require 7 days' notice to cancel. Bi-weekly and monthly subscriptions require 10 days' notice. This advance notice is necessary because microgreens are planted specifically for each scheduled order. Cancellations may be submitted by email (info@mighty-micro.com) or phone ((480)631-2880), which serve as reliable confirmation methods. No refunds post-harvest, but we offer credits for future orders. For quality claims, contact us within 24 hours with photo documentation—we'll replace or credit at our discretion. Due to the perishable nature of fresh microgreens, we do not accept returns. However, we guarantee quality upon delivery (see Section 8). Notice periods align with our grow cycle to reduce food waste.
8. Product Quality & Safety
MightyMicro guarantees freshness upon delivery. All food handlers are certified per Arizona requirements. When properly stored, microgreens maintain peak quality for nutrients up to 7-10 days but should stay fresh for two weeks (three weeks for pea shoots). Storage: Store microgreens at 35-40°F (1-4°C) in the coldest part of your refrigerator, away from the freezer compartment. Refrigerate immediately upon arrival and keep sealed until use. Food Safety: Rinse microgreens before eating and only prepare what you will consume immediately. As with all fresh produce in Arizona, customers should follow proper food handling practices. Allergy Notice: Microgreens may contain allergens. Customers with food sensitivities should review product information carefully. These guidelines protect health and maximize the benefits of our sustainable greens.
9. Intellectual Property
All Site content, including the MightyMicro name, logo, product photography, recipe cards, growing techniques, and written descriptions, is owned by us or licensed. You may not copy or use it commercially without permission. This protects our brand, built on passion for health and sustainability.
10. User Conduct
Provide accurate info when ordering. No resale of products without our approval, no bots, and no harmful actions, including but not limited to: unauthorized access attempts, fraudulent orders, harassment of staff, or violations of applicable laws. This ensures fair access and protects our small-farm operations.
11. Limitation of Liability
MightyMicro's liability is limited to refund or replacement only. Not liable for indirect, incidental, consequential, or special damages. Customer responsible for proper handling after delivery. Not responsible for spoilage, illness, or injury from improper storage, handling, or consumption. These limits are fair given perishable goods and Arizona consumer laws.
12. Dispute Resolution
These Terms are governed by Arizona law. Any disputes shall be resolved in Maricopa County, Arizona. Try informal resolution within 30 days first. For claims under $10,000, you may opt for binding arbitration via AAA with low fees—we'll cover filing if you initiate. No class actions. Arbitration is optional to make resolution faster and less costly, enforceable under Arizona law unless unconscionable.
13. Force Majeure
We're not liable for delays from weather, crop failure, or events beyond control, including but not limited to: extreme weather, crop disease, pest infestations, water supply issues, or supply chain disruptions. This accounts for Arizona's climate and farming realities.
14. Changes to Terms
We may update Terms with 30 days' notice via email and Site banner. Continued use means acceptance. We notify you to keep things transparent.
15. Privacy
We collect and store your contact and payment information to fulfill your subscription. We do not sell your information to third parties. By signing, you consent to receiving transactional emails and SMS related to your subscription. In the unlikely event of a data breach that involves unencrypted personal information, requiring notification under Arizona law (A.R.S. § 18-552), we will notify affected users within 45 days and outline steps we're taking to protect your data. You may request deletion of your account and personal data by contacting us at info@mighty-micro.com. We will process your request within 30 days, retaining only information required by law. 16. Contact, Severability, Entire Agreement

If any provision is unenforceable, others remain. These Terms, plus the Subscription Agreement and Privacy Policy, are the full agreement.
